By accessing or browsing this website (ahagency.net) and engaging AH Agency for design, engineering, automation, or marketing services, you agree to be bound by these Terms of Use. If you disagree with any part of these terms, please discontinue use immediately. You agree not to misuse our digital platforms, transmit malicious scripts, or reverse-engineer our proprietary software without prior written authorization.

All bespoke code, Next.js web applications, brand identities, logos, 3D visual renders, and automated workflow pipelines created specifically for paying clients become the exclusive property of the client upon final invoice settlement. AH Agency retains the perpetual right to showcase completed works, anonymized performance metrics, and aesthetic assets in our public agency portfolio, showreels, and case studies unless governed by a signed non-disclosure agreement (NDA).

Our agency operates on agile, high-velocity engineering sprints. Clients agree to provide timely feedback, brand assets, necessary API access credentials, and payment milestones according to the project proposal. Significant delays in client feedback may adjust the scheduled delivery roadmap. Scope additions beyond the initial contract will be estimated transparently before commencement.

To the fullest extent permitted by applicable law, AH Agency and its officers, engineers, and contractors shall not be liable for any indirect, incidental, or consequential damages resulting from third-party server downtimes, Meta or Google advertising account suspensions, algorithm shifts, or unforeseen data breaches on external hosting providers. Our total liability for any claim shall not exceed the total fees paid by the client for the specific service in dispute.

Many of our software solutions integrate with third-party providers including Vercel, Supabase, OpenAI, Anthropic, WhatsApp Cloud API, and Stripe. These external services are governed by their respective terms of service. AH Agency is not responsible for policy modifications, pricing changes, or feature deprecations enacted by these independent platform providers.

These Terms of Use and any separate client agreements shall be governed by and construed in accordance with the laws governing commercial business operations in our primary jurisdiction. Any dispute arising out of or related to these terms shall first be subject to good-faith mediation before formal legal proceedings are initiated.

AH Agency reserves the right to modify or replace these Terms of Use at our sole discretion. Any updates will be published immediately on this page with an updated timestamp. Continued engagement of our services or utilization of our digital platforms following changes indicates your formal acceptance of the revised terms.
